This document describes the privacy policy of personal data processed by Tomasz Radziewicz, conducting business activity under the name "Tomasz Radziewicz ART", ul. Jana Kochanowskiego 130 lok. J, 80 - 405 Gdańsk, entered in the Central Register and Information on Economic Activity, REGON 221718924, NIP 7431340135, operating an online store at www.radziewicz-art.com. The privacy policy sets out the rules, method of processing and use of data and information from potential customers, customers and users of the www.radziewicz-art.com website, as well as other people contacting him at the address or email address tom@radziewiczart.com (hereinafter referred to as "Users").
Requirement of using the www.radziewicz-art.com website and sending any personal data is to read this privacy policy.
By entering www.radziewicz-art.com, using it or sending us any personal data, the User accepts the terms of this privacy policy. If the User does not accept the content of this privacy policy, he/she should stop using the website www.radziewicz-art.com.

1.    Rules for the protection of personal data
1.1.    The administrator of personal data is Tomasz Radziewicz, who conducts business activity under the company "Tomasz Radziewicz ART", ul. Jana Kochanowskiego 130 lok. J, 80 - 405 Gdańsk, entered in the Central Register and Information on Economic Activity, REGON 221718924, NIP 7431340135 (hereinafter referred to as the "Administrator").
1.2.    All personal data are processed by the Administrator in accordance with generally applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on free the flow of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) (Journal of Laws of the EU, L. 2016, No. 119, p., as amended), the Act of 10 May 2018 on the protection of personal data (i.e., Journal of Laws of 2019, item 1781), the Act of 18 July 2002 on the provision of electronic services (i.e., Journal of Laws of 2020, item 344). and the Act of 18 July 2002 on the provision of electronic services (i.e., Journal of Laws of 2020, item 344), the Act of 16 July 2004, Telecommunications Law (i.e., Journal of Laws of 2019, item 2460, as amended), moreover in accordance with the scope of the consent given by the User. The administrator has developed internal procedures and other necessary documents to ensure adequate protection of Users' personal data, in addition, it regularly controls their use and compliance with applicable standards and regulations. The Administrator undertakes to comply with this privacy policy and make any changes to it in the event of a change in the generally applicable provisions of law in the field of personal data protection.
1.3.    The Administrator exercises due diligence that all personal data are processed in accordance with the purpose for which they were collected (so that the processing was carried out adequately for these purposes). The administrator processes personal data in accordance with the scope of consents granted by Users, in particular personal data is used by him in accordance with the scope of these consents and areas of processing allowed by law.
1.4.    When processing personal data, the Administrator applies the principles of adequacy and substantive correctness.
1.5.    The administrator ensures confidentiality, integrity and accountability of personal data processed, in addition, he uses technical and organizational measures required by law to ensure the protection of personal data being processed and personal data protection against disclosure to unauthorized persons.
1.6.    The Administrator processes the following Users' data: name, surname or company name, residence address, delivery address, contact details (e-mail address, telephone number), bank account number. The Administrator processes only personal data that are necessary to contact, perform a sales or service contract, manage or resolve requests, receiving  newsletter by Users, provided they have previously agreed to receive this newsletter. The administrator explains that when the subscription form is filled in, only the email address is processed.
1.7.    Personal data are processed by the Administrator for the period necessary to achieve the purposes for which they were collected, and then for the duration of any claims related to the use of the Online Store, including placing an order (until the limitation period of claims related to it), and for a period of time in which the Administrator is obliged to do so on the basis of generally applicable legal provisions (e.g. in the event that the User has received an invoice at his express request also until the expiry of the limitation period of the tax liability), while the personal data of the User who consented to the Administrator sending information about the Online Store in the form of a newsletter to the e-mail address indicated by him in the Form, will be processed until the consent is withdrawn. After this period, personal data will be irreversibly deleted or destroyed.
1.8.    The Administrator may disclose personal data to entities supporting it in conducting business activities and providing services within the Online Store (suppliers and subcontractors), i.e.: tax advisors, external legal offices, accounting offices / HR / accounting offices, entities providing technical / IT support / analytical providers of services related to the functioning of the Online Store, entities providing financial services (including banks), postal operators / carriers / couriers - as persons authorized to process personal data under the entrustment agreement concluded with the Administrator. The administrator may also transfer personal data to public authorities fighting fraud and abuse, as well as for other purposes arising from generally applicable laws, and other entities, if this is required by applicable law and / or necessary to perform the obligations imposed on the Administrator legal regulations. The Administrator does not transfer Users' personal data to third parties for marketing purposes. The administrator provides personal data for the implementation of the contract to its employees based on relevant authorizations.
1.9.    Personal data is not transferred outside the European Economic Area / are not transferred to a third country or international organization, except when:
a)    the delivery address indicated by you is outside the European Union and the European Economic Area and the transfer of these data is necessary for the performance of the contract between you and the Administrator,
b)    entities to which the Administrator provides personal data are based outside the European Union, which means that in the light of the provisions of the Regulation are treated as so-called third countries. 
The administrator ensures, however, that in this case it transfers data only to entities from the United States that joined the Privacy Shield program, in accordance with the European Commission implementing decision of July 12, 2016 (https://ec.europa.eu/info/law/law-topic/ data-protection/data-transfers-outside-eu/eu-us-privacy-shield_pl). 2.    Ways of getting data
2.1.    The administrator obtains personal data through:
a)    online completed form - information is collected through a form available at www.radziewicz-art.com, used to place orders in the Online Store by Users,
b)    contact without the intermediation of the network - at www.radziewicz-art.com there are telephone numbers and an e-mail address at which you can contact the Administrator.
2.2.    The online store run at www.radziewicz-art.com uses "cookies", which are IT data, in particular test files, which are stored on the Website User's end devices (i.e. computer, laptop, smartphone, tablet etc.). These files do not store Users' data, but only the file ID regarding the User's session posted on the Administrator's server.

3.    Cookies files
3.1.    The internet site www.radziewicz-art.com uses two types of "cookies", i.e.:
a)    session - temporary files that are stored on the Online Store user's end device (i.e. computer, laptop, smartphone, tablet, etc.) until they leave the website or turn off the web browser;
b)    permanent - they are stored on the User's end device for the time specified in the parameters of "cookies" or until they are deleted by the user.
3.2.    The website www.radziewicz-art.com uses "cookies" to constantly improve the Online Store, optimize its use, configure the website, implement processes necessary for the full functionality of the website, remember Users' settings (i.e. content of the Cart, page language ), in addition, audience analysis and research.
3.3.    The User may stipulate in the web browser's settings that he / she will not accept "cookies". However, this may cause that part of the Online Store's functions may be unavailable. In the web browser settings, it is possible to obtain information on how the User can prevent the browser from accepting new "cookies", moreover, how to set the browser so that the user is informed about the receipt of new "cookies".
3.4.    "Cookies" located on the user's end device may also be used by partners cooperating with the Administrator, in particular by:
a)    a) Google - in connection with the use of Google Analytics, which uses "cookies" to analyse how to use the website (information obtained using "cookies", allowing the collection of data on website statistics, is saved on the servers used by Google Inc. in the United States). b)    b) Facebook - in connection with the use of the Facebook Pixel tool supporting performance measurement. The administrator explains that the collected data is processed as part of the above services in an anonymous manner (in a way that prevents identification of the person), more information about the privacy standards of the tool can be obtained under the link - https://www.facebook.com/about/privacyshield.
3.5.    Files about the user's session, i.e. information about the contents of the cart and the language of the page, are stored by the Administrator on the server for a period of one month.

4.    Purposes of personal data processing
4.1.    Personal data provided by the Users of the website www.radziewicz-art.com are processed in order to conclude a sales contract, execute an order placed in the Online Store, issue a proof of sale and its delivery, consider claims regarding complaints/guarantees/warranty/withdrawal from the contract, possible defence against these claims, pursuing the Administrator's claims related to the implementation of the order placed in the Online Store, in addition for the purposes of fulfilling the obligations by the Seller under the applicable law, including tax law, i.e. pursuant to art. 6 clause 1 lit. b, c and f of the Regulation.
4.2.    Personal data provided by Users of the website www.radziewicz-art.com are also processed for marketing purposes, pursuant to art. 6 clause 1 lit. a and f of the Regulation, if they agree to the Administrator sending information about the Online Store (including information about Products, new Products, promotions) in the form of a newsletter to the e-mail address provided in the Form.
4.3.    The administrator also processes personal data for statistical purposes. The administrator explains that when visiting www.radziewicz-art.com, during which the User does not fill out forms, only statistical data is collected, such as the tabs visited and the amount of time spent on each of them, date and time of visit, web browser, page language. The legal basis is the Administrator's legitimate interest in improving the structure of the website and services, art. 6 clause 1 lit. f Regulations.

5.    Information about the Online Store
5.1.    Users have the possibility to receive from the Administrator free information about the Online Store (including information about Products, new Products, promotions) in the form of a newsletter to the e-mail address provided by them in the Form when placing the order in the Online Store after expressing by the them consent to receive this information.
5.2.    Expressing consent to receive Information about the Online Store is voluntary and is not a prerequisite for placing an order in the Online Store (using the services of the Online Store).
5.3.    Users may at any time, without giving a reason and without incurring any costs, change the previously indicated e-mail address to which information about the Online Store is sent, or opt out of further sending by the Administrator information about the Online Store by sending such a request to E-mail address: tom@radziewicz-art.com.

6.    Security and storage of personal data
The administrator ensures the security of personal data thanks to appropriate technical and organizational measures aimed at preventing unlawful processing of data and their accidental loss, destruction and damage.

7.    Rights of customers and users of the website
7.1.    Providing personal data by Users is voluntary, however it is a prerequisite for placing an order in the Online Store (using the services of the Online Store) or contacting it. In the remaining scope, providing personal data is voluntary, in particular consent to the Administrator sending information about the Online Store in the form of a newsletter to the e-mail address provided by them in the Form is voluntary and is not a prerequisite for placing an order in the Online Store (using the Online Store services).
7.2.    The Administrator respects the rights of Users of the website whose data are processed: access to data, rectification of data, deletion of data, restriction of processing, transfer of data, lodging a complaint to the body dealing with personal data protection.
7.3.    Users have the right to access their data and rectify, delete, request to limit the processing of personal data, subject to the cases referred to in art. 18 clause 2 of the Regulation (if processing has been restricted, such personal data may be processed, with the exception of storage, only with the consent of the data subject, or to establish, assert or defend claims, or to protect the rights of another natural or legal person, or with for important reasons of public interest of the Union or a Member State), the transfer or opposition to their processing. The scope and conditions for exercising these rights are regulated in detail in art. 15 -22 of the Regulation.
7.4.    Users have the right to withdraw their consent to the processing of personal data at any time, provided that the processing of personal data by the Administrator is based on such consent. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
7.5.    Users have the right to lodge a complaint to the supervisory body, i.e. the President of the Office for the Protection of Personal Data, if they consider that the processing of their personal data violates applicable provisions on the protection of personal data.    
7.6.    The person whose data is processed may ask the Administrator in writing or by sending an e-mail for information regarding personal data collected and processed by the Administrator. Such a person is entitled to withdraw the previously granted consent to the processing of personal data.
7.7.    The Administrator informs that due to the non-fulfilment of the conditions for the designation of the Personal Data Protection inspector (the requirements of compulsory status) he has not appointed such an Inspector, in particular considering that he is not a public body or entity, his main activity is not processing operations, which due to their nature, scope or purposes require regular and systematic monitoring of data subjects on a large scale, in addition, its main activity is not to process specific categories of personal data or personal data regarding convictions and offenses, Large-scale.

8.    Changes to the privacy policy and cookies and contact
8.1.    The administrator informs that changes in the privacy policy may be affected by changes in the legislative sphere in the field of personal data protection, as well as other factors. Users will be immediately notified of any changes on the website www.radziewicz-art.com.
